It is possible, in certain circumstances, to change the zone or development controls applying to a property. This is known as rezoning. Click here for advice about rezoning in the Marrickville Council area.
However, in anticipation of the forthcoming preparation of a new comprehensive Local Environmental Plan for the Marrickville Council area, reference should be made to the following advice issued by the Department of Planning (DoP) (see below).
Advice from Department of Planning regarding rezonings
In August 2005, DoP provided advice that states, “Councils are requested to avoid, wherever possible, resolving to prepare minor amendments to existing plans” except in certain situations – so that efforts may be directed to preparing a new Local Environmental Plan as required under the NSW Planning Reforms. In December 2005, DoP provided further advice to councils that states, “In considering draft LEPs, the Minister requires a clear exposition of the context and justification for the proposed changes to the planning controls… spot rezonings, or draft plans that apply to single sites, should be particularly well justified and a compelling case will need to be made.” Click here for a copy of the advice from DoP – which includes a list of the matters which must be addressed in justifying the need for a proposed rezoning.
In February 2006, DoP provided advice to councils that it has established a senior level panel to review draft LEPs. Changes have also been made to the Ministerial Directions issued under section 117 of the Environmetnal Planning and Assessment Act.
